A transit shipment means a shipment of waste through one or more countries other than the country of dispatch or destination. In case of a transit notification, the Human Environment and Transport Inspectorate receives that notification from the foreign authority. Regulation (EC) No 1013/2006 on shipments of waste offers the competent authority of transit the possibility of giving a tacit consent.
Change of procedure: tacit consent
The Human Environment and Transport Inspectorate has altered its procedure with regard to notifications for the transit of waste through Dutch territory with effect from April 17, 2020.
Until recently, the notifier received an e-mail in which the Human Environment and Transport Inspectorate indicated to make use of the tacit consent as included in Article 9, paragraph 1 of the WSR. The Human Environment and Transport Inspectorate has decided to further adapt its working method. The notifier no longer receives an e-mail in which it may be assumed that consent has been granted by the Netherlands. The notifier also does not receive a written decision with a stamped notification document.
In concrete terms, this means that 30 days after the date of acknowledgement of receipt by the competent authorities of destination, the notifier is in possession of tacit consent.
Does the consignee have pre-consented facility status? In that case, the tacit consent actually goes into effect within 7 working days after the competent authorities of destination have issued the acknowledgement of receipt.
