Waste shipments where the Netherlands is a transit country
If you transporting a waste shipment through the Netherlands to another country and the authorities of that country provided acknowledgement for the shipment, you will have tacit consent from the Human Environment and Transport Inspectorate (ILT) for the transit 30 days after the date the consent was given.
The European Waste Shipment Regulation, EWSR is known as the Europese Verordening Overbrenging Afvalstoffen, EVOA in the Netherlands.

Tacit consent
The notifier of the shipment will not receive a letter stating that consent has been granted by the Netherlands. Nor will the notifier receive a written decision with a stamped notification document. From 30 days after the acknowledgement of shipment from the competent authorities of the country of destination, the notifier in possession of stilzwijgende toestemming (tacit consent) from the ILT.

Validity of the tacit consent
The tacit consent of a transit authority expires 1 calendar year after the expiry of the 30-day period as defined in Article 9(1) of the EWSR. That is after confirmation of consent. This means that the tacit consent of the authority of transit actually takes effect 30 days after issuance of the confirmation of receipt from the authority of destination.
If the consignee has pre-consented recovery facility status the tacit consent takes effect 7 working days after the country of destination confirms acknowledgement of the shipment. The tacit consent can be valid up to 3 years, based on Article 14(2) of the EWSR.
Transit
"Transit" involves the shipment waste materials through 1 or more countries other than the country of dispatch or destination. In the case of a transit notification with the Netherlands as the country of transit, tacit transit consent is granted.
The ILT receives the transit notification from the competent authority. The EWSR allows transit authorities to grant tacit consent.
